Title: Nostalgia Critic is being sued for "copyright infringement".

Tommy Wiseau (Wiseau Studios) is suing the Nostalgia critic for "copyright infringement" over his review of "The Room". Now I'm no expert on copyright law, but aren't reviews considered fair game under the "fair use" clause. Not only is this abusing the law for personal gain, it is a direct violation of the first amendment. As such, I believe that Wiseman is to be punished for his gross misconduct.

The Plan: Massive boycott. Spread word around IRL and through the internet that ANYTHING with either the name "Tommy Wiseau" or "Wiseau Studios" is to be under boycott. This includes any films made by him, any DVDs of said films, any books written by him (or based on his works), any games based off of said works, any television viewings of the film not get any ratings, etc. Duration: Permanent, so he learns a lesson about unjust abuse of the law for personal gain and violations of the Constitution.

As far as I can tell, reviews are definitely Fair Use, since they're both "criticism" and "comment."

There are limits to how much of a piece you can use within fair use though. How long is the Nostalgia Critic's segment on The Room? I doubt he'd run afoul of copyright law but I'm sure there's some stupid loophole that Wiseau's moron lawyers found.

Or maybe this is like the Archie Comics lawsuit and someone's just lost his mind.

Only about as long as his normal reviews are (10-15 minutes I think). Even then, he only shows clips to show his points. The funny part is that the only video to actually get complaints about "copyright infringement" is The Room.

The review is 28:07 in length.  It's not available on his website, but it can still be watched on blip.tv (http://nostalgiacritic.blip.tv/file/3878344/)

Edit:  Just did some research and I found out it's not the review itself that's the problem.  When someone e-mailed "john @ theroommovie.com", he said "The clips of "The Room" has been alter[ed]."  The only image that was "altered" was a scene showing Wiseau's ass (basically, a censor deer head).

That makes it even stupider since censorship items appear on TV all the time.
